Terms of Service

⚠️ Important Notice: Not a Substitute for Professional Care

Eunoia is not a replacement for professional mental health treatment. If you are in crisis or experiencing a mental health emergency:

  • • Call 988 (Suicide & Crisis Lifeline in the US)
  • • Call 911 or your local emergency services
  • • Go to your nearest emergency room
  • • Contact your therapist or mental health provider directly

Agreement to Terms

By accessing or using Eunoia at beautifulthinking.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

The Service is operated by Clarity Bytes, LLC ("Company," "we," "us," or "our").

Eligibility

To use the Service, you must:

  • Be at least 13 years of age (or the minimum age in your jurisdiction)
  • Be at least 18 years of age to use the Service as a therapist
  • Have the legal capacity to enter into these Terms
  • Not be prohibited from using the Service under applicable law

Account Types

  • Patient Accounts: For individuals using Eunoia to support their therapeutic journey
  • Therapist Accounts: For licensed mental health professionals using Eunoia with their patients

Therapist accounts require verification of professional credentials. By creating a therapist account, you represent that you are a licensed mental health professional in good standing.

Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

  • Use the Service for any illegal purpose
  • Impersonate another person or misrepresent your credentials
  • Share your account credentials with others
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service's operation
  • Use the Service to harass, abuse, or harm others

User Content

Ownership

You retain ownership of all content you create on the Service ("User Content"), including reflections, journal entries, and notes.

License to Us

By submitting User Content, you grant us a limited license to:

  • Store and back up your content
  • Display your content to you and authorized users (e.g., your connected therapist)
  • Process your content to provide Service features

This license is solely for operating and improving the Service. We will not use your User Content for advertising or sell it to third parties.

Therapist-Patient Relationships

Eunoia is designed to support existing therapist-patient relationships. The Service does not:

  • Create a therapist-patient relationship
  • Match patients with therapists
  • Verify the nature of relationships between users

The therapeutic relationship exists between you and your therapist, not with Eunoia or Clarity Bytes, LLC.

Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Fees and Payment

Eunoia is currently offered free of charge during our early access period. We may introduce paid features in the future with advance notice.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "as is" without warranties of any kind
  • We do not warrant that the Service will be uninterrupted, error-free, or secure
  • We are not responsible for any decisions made based on information in the Service

THE SERVICE IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR CONDITION.

Limitation of Liability

To the maximum extent permitted by law, Clarity Bytes, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Termination

You may terminate your account at any time by contacting us at support@beautifulthinking.app. We may suspend or terminate your account if you violate these Terms.

Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service constitutes acceptance of the updated Terms.
